1. DEFINITIONS

For the purposes of these Terms & Conditions (“Terms”):

• “Customer”, “User”, or “you” refers to any person, entity, corporation, or authorized representative accessing our website, communicating with our staff, or utilizing our travel-related services.
• “Supplier” refers to airlines, hotels, DMCs, venue operators, transport operators, consolidators, payment processors, and any third-party service provider.
• “Travel Product” refers to flight tickets, accommodation, MICE arrangements, transfers, travel packages, event services, or related travel services procured through AA Aviation.

2. WEBSITE TERMS & CONDITIONS

2.1 Platform Usage
By accessing, browsing, or using our website, you acknowledge that all content, software, interfaces, and data are provided strictly on an “as-is”, “as-available”, and “best-effort” basis. AA Aviation may update, modify, suspend, or discontinue any element of the website without prior notice.

2.2 Intellectual Property
All trademarks, service marks, text, data, graphics, and proprietary materials are protected under Malaysian and international IP law. Unauthorized reproduction, distribution, modification, extraction, or exploitation is strictly prohibited.

2.3 System Integrity
Users shall not engage in actions that compromise the security, functionality, or integrity of the website, including but not limited to:

• Unauthorized access attempts,
• Deployment of bots, spiders, scrapers, or automated tools,
• System probing, reverse engineering, or circumvention of authentication,
• Introducing viruses, malware, or harmful code,
• Interference with network stability, bandwidth, or server resources.

2.4 Website Liability Disclaimer
AA Aviation disclaims all liability for direct, indirect, incidental, consequential, punitive, or reputational damages arising from:

• System outages or downtime,
• Transmission errors or data inaccuracies,
• Cybersecurity incidents,
• Device failures or network instability,
• Delayed access, latency, or unavailability.

Continued use constitutes acceptance of these Terms as amended from time to time.

3. TERMS OF USE

3.1 Contractual Relationship
This website is operated for the purposes of enabling Customers to:

• Obtain travel-related and aviation information,
• Review availability and pricing,
• Make legitimate bookings,
• Perform lawful transactions with Suppliers.

Use of the website constitutes a binding legal agreement between Customer and AA Aviation.

3.2 Entire Agreement
These Terms, together with referenced policies (including the Privacy Policy), constitute the entire agreement and supersede all prior proposals, communications, or representations.

3.3 Customer Representations
By using our platform, you warrant that:

• You are 18+ years old and legally competent,
• You will use the website for lawful and legitimate purposes,
• Information provided is accurate and current,
• Bookings made for third parties are authorized,
• Account credentials will be protected.

AA Aviation reserves discretion to restrict or terminate access for misuse, fraud, or abuse without prior notice.

4. SUPPLIER RULES & COMMERCIAL RESTRICTIONS

AA Aviation acts as a travel intermediary and facilitator. Travel Products are subject to Supplier rules including (but not limited to):

• Fare rules and payment deadlines,
• Refund and cancellation restrictions,
• Documentation and visa policies,
• Baggage rules and safety protocols,
• Deposits and minimum participation requirements (for MICE or event bookings).

Non-compliance may result in denied service, forfeiture of fees, penalties, or cancellations for which AA Aviation bears no liability.

5. PROHIBITED & RESTRICTED ACTIVITIES

Customers are strictly prohibited from:

1. Fraudulent Reservations
   • Making speculative, false, fraudulent, or test bookings,
   • Circumventing fare or booking systems,
   • Using bots or automated scraping tools.
2. Unauthorized Financial Activity
   • Using an invalid, expired, or falsified bank card or account,
   • Using a card or account without legal authorization,
   • Providing incomplete, outdated, or fraudulent payment data.
3. Identity Misrepresentation
   • Impersonating any person,
   • Misrepresenting identity, affiliation, or authorization,
   • Submitting false or deceptive documentation.
4. Unlawful Conduct
   • Violating any applicable law, regulation, or governmental directive,
   • Engaging in fraud, money laundering, or illicit financing.
5. Content Misuse & Platform Interference
   • Reproducing, framing, deep-linking, or extracting website content without consent,
   • Tampering with software, networks, or security controls.

If prohibited activity is suspected, AA Aviation may:

• Cancel bookings,
• Terminate accounts,
• Withhold refunds,
• Report activity to banks or authorities,
• Initiate legal proceedings.

6. SCOPE OF SERVICES

AA Aviation provides integrated travel and corporate mobility solutions including:

• Flight ticket reservations and issuance
• MICE (Meetings, Incentives, Conferences & Exhibitions),
• Hotel and accommodation bookings,
• Ground transport and logistical support,
• Travel packages and consultancy,
• Travel Insurance.

Service availability depends on Supplier capacity and regulatory conditions.

7. FLIGHT TICKET TERMS

7.1 Pricing & Fare Conditions
Airfares, taxes, surcharges, and ancillary charges are dynamic and influenced by:

• Airline revenue management,
• Seasonal inventory fluctuations,
• Currency exchange movements,
• Regulatory or fee changes.

Fare quotations are not guaranteed until full payment and ticket issuance.

7.2 Ticketing Deadlines
Airlines impose strict ticketing time limits (TTL). Failure to pay before TTL expiry may result in:

• Automatic cancellation,
• Loss of seat inventory,
• Fare reassessment at higher rates.

AA Aviation disclaims liability for delays beyond its control.

7.3 Amendments, Refunds & No-Show
Post-issuance actions are governed strictly by airline fare rules including:

• Penalties,
• Non-refundable terms,
• Rebooking restrictions,
• No-show forfeitures.

No-show events generally void refund eligibility.

8. REFUND POLICY BETWEEN COMPANY & CUSTOMER

8.1 Supplier-Controlled Refunds
Refund eligibility is determined by Supplier rules. AA Aviation does not determine refund outcomes and acts solely as an intermediary.

8.2 Airline Ticket Refunds

• Non-refundable tickets are not eligible for cash refunds unless mandated by regulation.
• Refund amounts (if permitted) are net of airline penalties, Supplier fees, and AA Aviation service fees.
• Refund processing may require submission through GDS/BSP/ARC channels.

8.3 Processing Timelines
Indicative (non-binding) timelines:

• Airline refunds: 6–24 weeks
• Hotels/MICE: 2–12 weeks
• Transfers/Ancillaries: 1–8 weeks

Delays caused by Suppliers, settlement systems, or financial intermediaries are not the responsibility of AA Aviation.

8.4 Service Fees
AA Aviation service fees are non-refundable, regardless of Supplier outcomes.

8.5 Payment Method
Refunds are issued via original payment method unless Supplier rules dictate otherwise. Banking fees and FX losses are borne by the Customer.

9. LIABILITY

9.1 Supplier Information & Accuracy
Supplier Content may not always be accurate, and AA Aviation shall not be liable for losses arising from inaccuracies, incompleteness, or outdated information, except where prohibited by law.

9.2 Customer Input Errors
AA Aviation assumes no liability for losses arising from incorrect data submitted by the Customer including:

• Incorrect passenger names,
• ID details or nationality,
• Contact information,
• Payment data,
• Travel dates, routes, or times.

Such errors may result in inability to board, check-in, or utilize Travel Products.

9.3 Documentation & Compliance
AA Aviation shall not be liable for losses resulting from:

• Failure to obtain passports, visas, permits, or vaccinations,
• Failure to purchase travel insurance,
• Non-compliance with Supplier rules,
• Late arrival at check-in or boarding gates,
• Behaviour deemed unacceptable by Suppliers,
• Missed connections due to Customer acts or omissions,
• Invalid discount, entitlement, or loyalty instruments,
• Duplicate or erroneous bookings,
• FX losses or banking fees,
• Direct communications between Customer and Suppliers,
• Inaccurate ratings or reviews,
• Outdated or incomplete payment information,
• Travel to restricted or advisory-listed locations.

9.4 Force Majeure
AA Aviation shall not be liable for disruptions caused by:

• Natural disasters,
• Pandemics or epidemics,
• War, terrorism, riots, sanctions, embargoes,
• Governmental directives,
• Telecommunications or system failures,
• Cyber incidents or hacking.

9.5 Business Use Exclusion
The platform is intended for private use. AA Aviation has no liability for:

• Loss of profit,
• Loss of business,
• Business interruption,
• Loss of opportunity.

9.6 Maximum Extent Allowed by Law
Nothing in this section limits liability where such limitation is prohibited by Malaysian law.

10. INDEMNIFICATION

The Customer agrees to indemnify and hold harmless AA Aviation, its directors, employees, affiliates, and agents from claims, penalties, damages, legal costs, and liabilities arising from:

• Breach of these Terms,
• Violations of law,
• Misuse of the platform,
• Infringement of third-party rights,
• Non-compliance with Supplier terms.

11. TRAVEL DOCUMENTATION & HEALTH REQUIREMENTS

Customers are solely responsible for ensuring possession of valid:

• Passports,
• Visas and entry permits,
• Vaccination or health records,
• Insurance documents.

AA Aviation disclaims liability for denied boarding, deportation, or fines related to documentation failures.

12. PRIVACY & DATA PROTECTION

AA Aviation collects and processes personal data in accordance with Malaysian privacy laws. Our Privacy Policy specifies:

• Data collection,
• Usage purposes,
• Storage and security,
• Disclosure conditions,
• Customer rights.

13. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of Malaysia. Customers agree to the exclusive jurisdiction of Malaysian courts for dispute resolution. If any provision is deemed invalid, the remainder shall remain enforceable.
